Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and BTCvds ("we", "us"), the operator of BTCvds at https://btcvds.com. By creating an account, placing an order or using any of our services you accept these Terms, our Privacy Policy and our Refund Policy. If you do not accept them, do not use the services.

You must be at least 18 years old and legally able to enter into contracts. If you act on behalf of a company, you confirm that you are authorized to bind it to these Terms.

2. Your account

You sign up with an email address and a password. You must use an email address you control: it is the only way we can reach you and the only way to recover access. Keep your password secret. You are responsible for all activity under your account, whether or not you authorized it.

3. The services

We provide unmanaged virtual private servers ("servers") in the locations and configurations listed on the Pricing page. Each server comes with the resources stated for its plan and root (administrator) access.

A server is ordered and paid for from your account balance. Setup starts once the order is placed and may take some time; the server's IP address and access details appear in your dashboard when it is ready.

Servers are unmanaged. We keep the host hardware and network running, but we do not install, configure, secure, monitor, update or back up the software on your server. We may perform maintenance that briefly interrupts service and will try to give notice when we can.

We do not guarantee any specific uptime. Resources such as CPU time, disk input/output and network capacity are shared with other customers on the same host; we may limit a server that degrades service for others.

4. Balance, prices and payment

Your account has a balance in US dollars. You add money to it by paying a top-up invoice in cryptocurrency. Orders and renewals are paid only from the balance: an order can be placed only when the balance covers its full price, and the price is taken from the balance when you place it.

Prices are listed in US dollars and may change at any time. A change never affects an order already placed or a period already paid. Renewals are charged at the price of your plan and the discount of your billing period in force on the renewal date.

The balance is not a bank account or stored-value instrument. It earns no interest, can be used only to pay for our services, and cannot be withdrawn, transferred to another account or exchanged back to cryptocurrency or any other money.

We accept payment only in the cryptocurrencies listed at checkout. When you choose a coin, we convert the top-up amount at the current exchange rate and fix that rate for 30 minutes. You must send the exact amount shown, to the address shown, on the network shown, within that window.

  • Network and exchange fees are yours to pay. The amount we receive must not be lower than the amount shown.
  • A payment that arrives short, late, on the wrong network or to the wrong address may not be credited. Coins sent on the wrong network or to a wrong address may be lost permanently and we cannot recover them.
  • A payment is complete when it reaches the number of blockchain confirmations we require for that coin.
  • Longer billing periods may carry a discount. The discount applies only to that period.
  • Payments in some coins may be screened for fraud and for funds linked to illegal activity. A top-up flagged by such a check is marked "Blocked by anti-fraud check" and is not added to your balance while it is reviewed. We may ask you for information about the source of the funds. A blocked payment is not refunded.

5. No refunds

All payments are final and non-refundable. We do not return payments or balance in whole or in part, in cryptocurrency or in any other form, for any reason, including but not limited to: money left on your balance, including when you close your account or it is terminated; unused time on a billing period; cancelling a server early; dissatisfaction with performance or location; mistakes in the plan, period or operating system you chose; suspension or termination for breaking these Terms; and changes in the value of the cryptocurrency you paid with.

Details on underpayments, overpayments and late payments are in the Refund Policy. Where mandatory law gives you rights that cannot be waived, those rights are not affected.

6. Renewal, expiry and deletion

Each server is paid for in advance for the billing period you choose. Renewal is automatic: at the end of the paid period the price of the next period of the same length is taken from your balance, and the server keeps running. Keep enough money on your balance; the dashboard warns you about upcoming renewals.

If the balance is too low on the renewal date, the server is suspended. We keep trying to charge the balance for 3 days. If you top up within that time, the renewal is charged, the server is restored and the new period starts on the day it is charged. After 3 days the server and all data on it are permanently deleted and cannot be recovered.

7. Acceptable use

You may use your server for any lawful purpose. You must not use it, or let anyone else use it, to:

  • send unsolicited bulk email or other spam, or host sites advertised by spam;
  • launch or take part in denial-of-service attacks, port scans, brute-force attempts or any other unauthorized access to systems;
  • distribute malware, run botnet command servers, or host phishing or fraudulent sites;
  • store or distribute child sexual abuse material. We report it to the authorities;
  • infringe copyright, trademarks or other intellectual property rights;
  • run open mail relays, open resolvers or open proxies that are abused by third parties;
  • harass, threaten or dox any person, or incite violence;
  • break the laws of the country where the server is located or of [Country / state of incorporation];
  • place excessive, sustained load on shared resources that degrades service for other customers.

If we receive an abuse complaint, we may ask you to fix the problem within a set time.

8. Suspension and termination

We may suspend or terminate a server or an account, with or without notice, if you break these Terms, if we are required to by law or a competent authority, or if your use puts our network, other customers or third parties at risk. Suspension or termination for these reasons does not entitle you to a refund or a credit.

You may stop using a server at any time. Unused time is not refunded. You may ask us to close your account; money left on the balance is not refunded. Records we must keep by law are kept as described in the Privacy Policy.

9. Your data and backups

You own the data you store on your server. We do not access it except to provide the service, to investigate abuse, or when required by law. We do not back up your server. Keeping copies of your data is your responsibility.

10. No warranty

The services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the services will be uninterrupted, error-free or secure.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the services is limited to the amount charged for the affected server in the one month before the event that caused the claim.

12. Indemnity

You agree to defend and compensate us for any claims, losses and costs (including reasonable legal fees) arising from your use of the services, the content on your server, or your breach of these Terms.

13. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in your dashboard. If you keep using the services after a change takes effect, you accept the new Terms.

14. Governing law

These Terms are governed by the laws of [Country / state of incorporation]. Disputes are settled by the courts of [Country / state of incorporation], unless mandatory law gives you the right to bring a claim elsewhere.
